TERMS AND CONDITIONS OF BOOKING
By making a reservation with rentavillamallorca.com (hereinafter RVM) the client accepts the 'Terms and Conditions' detailed below:
1. Activity and services of Rent a Villa Mallorca.
Rent a Villa Mallorca offers the mediation of third party services on the website, namely contracts with the owners of holiday properties and Rent a Villa Mallorca therefore only acts as an intermediary between the client and the owner.
2. Booking process
The rental contract with the owner and the client comes into effect upon receipt of the booking confirmation (declaration of acceptance), which RVM acts as agent and representative of the lessor on his behalf. The booking confirmation does not require a specific form. The client shall note the number of persons and animals specified in the reservation. Reservations can be made without individual communication through an online booking process (e-business contract).
The following applies to the conclusion of the contract: The contract comes from the receipt of RVM's booking confirmation with the customer.
RVM is authorized to charge all payments, also with regard to cancellation fees and other payments of the lessor, as sales representative for collection by the lessor.
For the confirmation of your reservation a NON-refundable deposit of 30% of the total rental price must be paid, the remaining amount must be paid one month before the beginning of your stay, NON-refundable. If payment is not made, your reservation will be cancelled.
If payment is not made within the aforementioned period, the vacation home will appear available for all purposes in accordance with the contract and there is no contractual or legal right of retention by the client, RVM is entitled to issue a warning with a deadline and to authorize the lessor to terminate the contract and to charge the client on behalf of the lessor a fixed cancellation fee.
3. Prices / offers
The valid prices for a reservation will always be those published on the website at the time of the reservation.
RVM reserves the right to publish last minute offers without prior notice and at its convenience, so the client will not be able to demand any kind of discount or reduction after the confirmation of the reservation.
4. Responsibilities
The descriptions, photos and other information published on RVM are in accordance with the characteristics of each property at the time they were registered on our website. RVM is committed to update this information as much as possible, so these, as well as the published photos can change without previous notice. RVM is not responsible for possible changes of furniture or equipment that may occur between the confirmation of the reservation and the entrance in the property by the customer.
RVM is not responsible for possible modifications in case of force majeure such as pandemic, epidemic, strike, war, earthquakes, electricity or water cuts, storms, works near the property and other circumstances not foreseeable at the moment of the reservation.
RVM is also not responsible for the malfunctioning of appliances, heating, air conditioning, swimming pool, Internet, etc. Although RVM checks periodically the good functioning of the equipment of each property; this depends ultimately on the owner. If the client detects any malfunction, he/she should contact RVM immediately, so that the owner can solve the malfunction as soon as possible. However, it must be taken into account that it is necessary that some time elapses between the detection of the problem and its solution. That is why RVM will not pay and will not be responsible for possible claims for malfunctions after the departure.
The good use of the property including the objects inside the property such as appliances, furniture, etc. and outside such as swimming pool, barbecue, etc. will be the responsibility of the client.
RVM is not responsible for possible accidents that may occur during the stay, nor for theft or subtraction of any type of objects inside or outside the contracted property.
All claims must be presented in writing to the owner or to RVM.
5. Breakdowns / breakages
The client undertakes to respect the property and all the objects in it. In case of breakage or damage, the client must contact the owner or IPM within 24 hours so that the breakage or damage can be repaired. Likewise, the client will be able to claim an economic compensation in case the breakage or damage is his responsibility.
6. Modifications / cancellations by RVM
The following shall be grounds for cancellation of the contract by RVM:
a) ...breakages or breakdowns due to a bad use by the client or his companions. b) ...noises or disturbances caused to neighbors or other persons. c) ...not respecting the rules that the owner imposes on his property such as swimming pool schedules, use of air conditioning, etc.
d) ...any electric vehicle that needs to be recharged is not allowed to do so in the vacation home without prior authorization from the owner or IPM. And if it is the case, the consumption will be paid separately. e) ...not paying the rest of the total amount of the reservation at the moment of the key handover or not paying a deposit in the properties where this is required.

In this case the client will lose the confirmation prepaym.
7. Cancellation fees
RVM charges the following cancellation fees when the client makes the cancellation:
Loss of the deposit of 30% of the total rental price made at the time of booking.
If the cancellation is made within the four weeks prior to the start of the stay, the full amount of the rental will be charged.
In case RVM cancels the reservation, it will offer the customer a similar establishment. If the customer does not accept it, the paid amount will be refunded without further costs.
We recommend you to take out a travel insurance.
7.1.Conditions of change of reservation and dates:
The final price of the second reservation must be equal to or higher than the final price of the first reservation.
The remaining payment must be made at the time of the change of dates. The new reservation will not be made without the final payment. The customer must pay the usual cancellation fees to cancel the initial reservation.
If the customer cancels the rebooking of a change of dates, the customer incurs a 100% cancellation fee.
If the agency cancels the new reservation of a change of dates due to the unavailability of the reserved property, the client will be offered an equivalent property in quality and price at RVM's discretion. The amount paid by the client will not be refunded.
If the customer wants a more expensive property, he/she will have to pay the difference in price at the time of the new reservation.
8. Reservation conditions.
Law 2/2016, of March 30, of the tax on tourist stays in the Balearic Islands and measures to promote sustainable tourism.

We inform that, since July 2016, is legally in force a new tax on tourism in the Balearic Islands, this "Tourist Tax" / "Ecotasa" is not included in the price unless it appears as a supplement in the reservation and must be paid separately. 

The prices can be altered by season and year, and will depend if there is an update of the "Govern de les Illes Balears". In the case that the amount changes, the corresponding updated amount of the "Govern de les Illes Balears" must be paid on the date of stay of the reservation.
Applicable law and competent jurisdiction
Reservations shall be governed and interpreted in accordance with Spanish Law and shall be subject solely and exclusively to the jurisdiction of the Courts of Inca or Palma de Mallorca (Balearic Islands).
The client at the moment of making the reservation accepts the above mentioned law and jurisdiction, not being able to claim in other courts other than those of Palma de Mallorca.
